Offers and negotiation
From closed comparable sales, adjusted for condition, lot, orientation and finish level, delivered to you in writing before the offer goes out. The list price is the seller's opinion; the comparables are evidence.
Earnest money, the length of the due diligence period, financing and appraisal contingencies, closing date, possession, and any seller contribution toward closing costs. Sellers frequently accept a lower price for better terms.
The contract's appraisal contingency governs. Options generally include renegotiating the price, covering the gap in cash, splitting the difference, or terminating under the contingency. Which is right depends on how strong the comparable support actually is — which you will already know, because it was analysed before the offer.
It is negotiated rather than fixed, and it is a signal of seriousness. It is credited to you at closing and is protected by your contingencies while they remain in effect.
